DMR Framing rules of use to ensure a safe contract of service
between us the supplier and you the customer.
1) Legal. We reserve the right to refer to English law to uphold and
protect our good name and property at all times. Each sale shall be deemed
to be performed in England.
2) Effect. When you view the DMR Framing website you are bound by our
terms and conditions and re-affirm these terms each time you re-visit the site.
3) Contract. When you register to buy online your details must be true
and any credit card must be yours to use by right and registered to you as such.
Any changes of card and/or address should be notified to us immediately.
DMR Framing reserves the right to cancel an account at its own discretion
if it is deemed to be in breech of our terms.
4) Payment. Payment will only be taken when the goods are shipped.
All though we do not envisage them any delays will be brought to your
attention as soon as we are aware of them.
5) Using our Web Site. Our online services are not available to, and
may not be used by, persons under the age of 18 years or to temporarily or
indefinitely suspended account holders. If you are under 18 years old, you
can use this service only in conjuction with and under the supervision of a
parent or guardian. If you do not qualify, please do not use these services.
If you are registering as a business entity, you represent that you have
the authority to bind that entity to this User Agreement.
6) User ID. You must choose a User ID and password on completion of
registration. You are responsible for all actions taken under that User ID
and password and shall only use or utilise the Site using your own User ID
and password. You must use every effort to keep your password safe and should
not disclose it to any other person. You shall not transfer or sell your
User ID to any other person. You shall not permit, either directly or
indirectly to any other person to unitilise your User ID or password.
7) Use of Email Tools. You may not use the Email Tell a Friend
service, or other email forwarding services that we offer, to send spam
or otherwise send content that would violate our User Agreement. We do
not permanently store the email messages or email addresses.
8) Tax. VAT at 15% will be raised on all DMR Framing
products where applicable. The customer will be responsible for
all other applicable duties.
9) Corrections. All desriptions of goods and services are true to
the best of our knowledge. Any omissions will be corrected as soon as
we become aware of them. Colours and appearances may vary slightly from
what you view on screen. No attempt to decieve is made and all our
products are of the highest quality.
10) Copyright. Viewing our website is free but please do not
infringe our copyright.
11) Limitation of Liability. Nothing in this User Agreement shall
limit or exclude our liability for fraudulent misrepresentation, or for
death or personal injury resulting from our negligence or the negligence
of our, agents or employees. Subject to the foregoing, we (our officers,
directors, agents and employees) will not be liable for any economic losses
(including, without limitation, loss any loss of goodwill or reputation, or
any special, indirect or consequential damages (however arising, including
negligence) arising out of or in connection with this User Agreement.
We (including our officers, directors, agents and employees) also have no
liabilty of any sort (including liabilty for negligence) for services or
for faults in or failures of their networks and equipment.
Our liabilty to you or any third party, and the liabilty of our officers,
directors, agents and employees, in any circumstance is limited to the
greater of (a) the total fees you have paid to us in relation to the
listing or other service offered giving rise to liability, and (b) £500.
12) Indemnity. You agree to indemnify and hold us and (as applicable)
our officers, directors, agents and employees, harmless from any claim or
demand, including reasonable legal fees, made by any third party due to or
arising out of breech of this User Agreement (including the documents
incorporated by reference), or your violation of any law or the
rights of a third party.
13) Consequential loss. In the event of consequential loss, DMR Framing
can only be responsible for the cost of your order.
14) Reasonable Control. DMR Framing will not be liable for failure
to perform its obligations within this agreement due to circumstances
beyond our control.
15) Changes to this agreement. DMR Framing reserves the right to
review its terms and conditions regulary and make changes as are deemed
necessary. In the event of any term of this agreement being held to be
unenforceable or invalid by judicial process the other terms will
remain valid and enforceable.
Security and Privicy.
DMR Framing wish to reassure you that any information you give us is
deemed confidential and will not be shared with third parties unless
you have given your express permission. We may contact you from time to
time with news of special offers or discounts, new products or general
information about ourselves. Information is collected - lawfully in
accordance with the data protection act. |
